These terms are the agreement between you and the developer of MudQuest. Please read the safety section even if you skip the rest — MudQuest is a convenience tool for off-road driving, not a safety device, and using it as one could get someone hurt.

1. Definitions
- App — the MudQuest iOS application.
- Mesh — the direct phone-to-phone network MudQuest forms over Wi‑Fi, with no internet or cell service.
- Service — the App together with the optional cloud account that backs up your content.
- Content — anything you create in the App: your profile, rigs, saved runs, trails, pins, chat messages and scans.
- You — the person using the App.
2. Acceptance and eligibility
By downloading or using the App you accept these terms. If you do not accept them, do not use the App.
You must be at least 13 years old (or the minimum digital-consent age where you live, if higher). If you are under 18, you may use MudQuest only with a parent or guardian's involvement. You must hold a valid driver's licence to drive a vehicle while using this App, and you must obey every law that applies to you on the trail and on the road.
3. Licence
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control. You may not:
- copy, modify, translate, reverse-engineer, decompile or disassemble the App;
- rent, lease, sell, sublicense or redistribute it;
- use it to build a competing product, or scrape its data;
- interfere with the mesh protocol, impersonate another rig, or attempt to intercept or spoof other users' mesh traffic;
- use it for any unlawful purpose, including trespassing on private or closed land.
4. Safety — read this one
MudQuest is not a safety device and is not a substitute for proper preparation. Specifically:
- It is not an emergency beacon. It does not contact emergency services, search and rescue, or any monitoring service. It is not a PLB, an InReach, or a satellite messenger. Carry a real emergency device when you go out of signal.
- The mesh has a short range and no guarantees. Roughly 30–60 m line of sight between phones, degraded by terrain, vehicles, weather and battery state. It can fail silently at any moment. Never plan around it working.
- Do not operate the App while driving. Set it up before you move, mount your phone properly, and keep your eyes on the trail. You are responsible for driving safely and lawfully at all times.
- Maps, trails and navigation may be wrong. Map data, elevation, government trail geometry and turn-by-turn guidance can be inaccurate, out of date, or wrong about whether a route is legal, open, or passable by your vehicle. Verify with official land-manager sources before you drive.
- Trails shared by other users are not vetted by us. A route existing in MudQuest is not permission to drive it and not a claim that it is safe.
- Off-roading is inherently dangerous. You accept that risk. You are responsible for your vehicle, your passengers, your recovery gear and your decisions.
5. Your account
You are responsible for keeping your sign-in credentials secure and for everything done under your account. Tell us promptly if you suspect unauthorised use. An account is optional — much of the App works without one — but without it your Content exists only on your device.
6. Your content
You own your Content. We claim no ownership of your runs, trails, profile or scans.
You grant us a limited licence to store, back up, transmit and display your Content solely to operate the Service for you — for example, to sync a saved run to your other device. This licence ends when you delete the Content or your account.
When you set a convoy to public, you are choosing to publish its name, blurb and location to all MudQuest users. Do not make a convoy public if you do not want its location seen.
You are responsible for your Content, and you confirm you have the right to share whatever you upload.
7. Acceptable use
Do not use MudQuest to:
- harass, threaten, stalk, impersonate or endanger anyone;
- broadcast unlawful, hateful or sexually explicit content over chat or push-to-talk;
- track or locate another person without their knowledge and consent;
- trespass, damage land, or drive where motorised travel is prohibited;
- disrupt, overload or attack the Service, or abuse the public-convoy layer with false or spam entries;
- circumvent a block. If someone blocks you, that decision is final.
We may suspend or terminate access for a violation, and may remove public convoy entries at our discretion.
8. Deleting your account
You may delete your account at any time from Settings ▸ Delete Account. Deletion permanently removes your account, all Content stored in your cloud area, and this device's copy of it. It requires an internet connection — the deletion must reach our servers to take effect — and it cannot be undone. Content already received by other rigs over the mesh (a chat message someone's phone has, a trail you shared with a convoy) is on their device and is beyond our reach to delete.
9. Third-party services
MudQuest depends on Google Firebase, Mapbox, Apple, and — if you use them to sign in — Google and Facebook. Your use of those services is governed by their own terms. We are not responsible for their availability, accuracy or conduct. Map data is provided by Mapbox and its data sources.
10. Price
MudQuest is currently free. If paid features are ever introduced, the terms and price will be disclosed before you are charged, and any purchase will go through the Apple App Store under Apple's rules.
11. Disclaimer of warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that the mesh will connect, that positions will be accurate, or that map or trail data will be correct or current.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, vehicle damage, property damage, personal injury, or loss arising from your use of — or inability to use — the Service, including any failure of the mesh, any inaccuracy in map, trail or navigation data, or any reliance on the App in an emergency.
Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the six months before the claim, or USD $100.
Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
13. Indemnification
You agree to indemnify and hold harmless the developer from any claim or demand — including reasonable legal fees — arising from your Content, your use of the Service, your driving, or your breach of these terms or of any law.
14. Termination
You may stop using the App at any time and delete your account. We may suspend or terminate your access if you breach these terms or if we discontinue the Service. Sections 6, 11, 12, 13 and 15 survive termination.
15. Governing law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.
Talk to us first. Before filing anything, email zivou4@gmail.com and give us 30 days to resolve it informally. Most things get sorted this way.
If we cannot resolve it, any dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Texas or by video, rather than in court — except that either of us may bring a claim in small-claims court, and either of us may seek injunctive relief for intellectual-property misuse. You and we each waive any right to a jury trial and to participate in a class action.
You may opt out of arbitration by emailing us within 30 days of first accepting these terms; opting out costs you nothing else. If you are a consumer in the EU, the UK, or another jurisdiction whose law grants you the right to sue locally, this section does not remove that right.
16. Apple App Store
These terms are between you and us, not Apple. Apple has no obligation to provide support for the App. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple is a third-party beneficiary of these terms and may enforce them. Your use is also subject to Apple's Licensed Application End User Licence Agreement, which prevails over these terms where they conflict.
17. Changes
We may update these terms. Material changes will be reflected in the date at the top of this page. Continuing to use the App after a change means you accept the updated terms.
